Nursing Home Abuse and Neglect
It is difficult when families realize they can no longer provide the care needed by a member of their family. Often times this realization forces them to look to others for help. In some instances after exhausting all options, it becomes apparent nursing home placement is the only viable choice. The choice is typically met with mixed feelings of both hope and sorrow. Once placement occurs, the family rightfully expects their loved one will receive the best care possible.
But, what happens when that does not occur? What happens when instead of receiving good care the family member is abused or neglected? The Illinois Court system provides a remedy. A claim can be filed pursuant to the Nursing Home Care Act on behalf of the victim of abuse or neglect. The Nursing Home Care Act provides residents of nursing homes with certain rights. Included in their rights is the basic right to be free from abuse and neglect. Abuse and neglect can be subtle or take on obvious forms. For example, bedsores, dehydration, malnutrition, unexplained bruising and falls are signs of abuse and neglect.

Wrongful Death
A Wrongful Death claim arises when the devastating, heart-wrenching, tragic and unexpected death of a loved one results from the negligent, careless or reckless conduct of another. The death can result from an act or failure to act. Pursuant to the Illinois Wrongful Death Act the family has a right to seek compensation for the untimely loss of their loved one.
While compensation will never replace the loved one in the hearts of the families, it is the only civil remedy our court system has to try and right a devastating wrong. With Wrongful Death claims damages vary, but could include compensation for loss of companionship of the loved one, loss of affection and love, as well a loss of the financial contribution made by loved one.
